Yes it is, Mr. Obama, but we need you to just hang in there! I am writing this to commend you after one year of service since you were elected as our president. You have done–and are doing, overall–a very difficult, very respectable job of turning this country around from its former direction of disaster. And now, you also have the Haiti earthquake disaster to handle, on top of it all.

True, I am not happy about the failure of universal single-payer, health care for all Americans, or the difficult decision you made to increase troop involvement in Afghanistan, but I understand the problems are indeed, complicated.

I trust in your judgment, however, and I do have greater expectations from you, for the new year ahead, the remainder of your term in office, and especially from the congress and senate, that will continue the progressive, Democratic changes we so strongly believe are in the best, and vital interest of all the people of the United States. I know that I speak for many other Americans, as well.

An In-Depth Look At Food Security

First, some definitions of food security, which seem very basic–my own is–when I am hungry, I must always have fresh water, and nutritious, balanced diet, food on hand, on demand, and in my possession to prepare, cook, and serve–and having the propane, stove, and cookware utensils to do it with–without having to depend on soup kitchens 7-days a week; especially in the winter season, if I am sick, during extreme weather, or if I lack transportation. Any thing less than that, automatically becomes food insecurity.

The USDA definition of food security is:

“Access by all people at all times to enough food for an active, healthy life. Food security includes at a minimum: (1) the ready availability of nutritionally adequate and safe foods, and (2) an assured ability to acquire acceptable foods in socially acceptable ways (e.g., without resorting to emergency food supplies, scavenging, stealing, or other coping strategies).”

Food insecurity: “Limited or uncertain availability of nutritionally adequate and safe foods or limited or uncertain ability to acquire acceptable foods in socially acceptable ways.”

Hunger: “The uneasy or painful sensation caused by a lack of access to food. Hunger may produce malnutrition over time…Hunger…is a potential, although not necessary, consequence of food insecurity.”

That was and still is my minimum requirement for survival; difficult to maintain, easier done in a motor-home than from a tent in the wetlands, yet for others it was not possible to even come close to that goal, as it more or less related to stability at one’s campsite; whether your camp equipment was stolen by other homeless predators, or stolen by enforcement predators, in the name of “public sanitation”.

Notice that the government seems to suggest that, along with “scavenging” (in dumpsters), or stealing, “resorting to emergency food supplies” is not socially acceptable, either! I admit I have rummaged through dumpsters, and I have found some really good food and other usable items ( like a complete working Gateway PC system!), at times, near the University of Oregon! But this is why recycling, or giving leftovers to to poor is better, in my opinion because dumpster diving is hard, dirty work. To hell with the socially acceptable, baloney! Hunger will motivate you, in ways you did not know you could act.

In my definition, I simply meant I did not wish to “depend” on soup kitchens, or food boxes, although I certainly did depend on them, and still do occasionally. No one should feel, or ever be made to feel, so strongly against taking a hand-out from charity, or government food assistance in food stamps that they, or their families, ever go hungry! That is just plain foolish pride! It is difficult enough for some new people who experience unemployment; or homelessness, and hunger due to what the USDA referrers to as “financial resource constraint” , to bring them to join the lines for food, around our community.

As homeless people get older, or become disabled and camp sweeps become bolder, it becomes more of a challenge to store, or carry belongings, and then travel to every food location serving hot meals daily, and it therefore becomes a guaranteed risk to the overall security of that person’s possessions left behind at camp that may very well be stolen, or confiscated, should he or she leave to go eat.

Another thing–as a life-long registered voter, I will never forget that it was every one of you Republican S.O.B.’S who tried to starve myself, and all the poor here in Oregon, when they drastically cut food stamps several years ago, as a part of welfare reform war.

You are the vipers that must be forever, defeated in every way into extinction; as being a murderous, hate-filled, bunch of psychopaths capable and ready again, should you ever come into power, to remove our rights, to use starvation against us because of our food insecurity, and the dire shortages of donations from faith based organizations, that you will have caused by dragging down the economy, while blaming us for it all.

I will never forget–and neither should any one else–that it was the Democrat for whom the majority of us voted, President Barack Obama, who greatly increased the food stamp benefits, right from the start of his election into office; and therefore put more food in our stomach, on a consistent basis for an entire month. Before he did that, I did not experience a sufficient degree of food security, or even enough of what I needed for the entire month; which left me hungry towards the ending weeks, and then after grocery food shopping, or getting a food box, I then had problems keeping myself from binges of overeating !

The sad truth is that a number of you right here in Eugene do, in your ignorance and your contempt-poisoned arrogance, favor denying food to the poor here, and do believe and preach, that it would discourage the homeless from living here. That is wishful thinking by stupid thinkers blinded by hate, with hearts hardened by greed, and posted in cowardice, anonymously, in our local news web forums.

Read it with your own eyes; follow this link below to comments on KVAL TV, about “downtown solutions” to homelessness–notice they switched to the use of the pejorative term, “transients”. Also realize that the homeless problem ranges well beyond downtown area. The homeless are not supposed to be visible anywhere, not just downtown, but anywhere within the city limit.

Those of you who would use food denial as a weapon–shame on you, Eugene’s homeless-hating, gang of thugs! So many of you it seems, are addicted to punishment and just driven to insanity to promote criminalization, jail and exclusion, as the only fitting solution to rid yourselves of the civic responsibility to help others less fortunate, who are suffering, or who would otherwise be forced to suffer, if you had your wicked way.

Well, I can say with pride, that we can all give thanks on this Day of Thanksgiving 2009, that here in Eugene, and throughout Lane County, such foul and–no pun intended–disgusting food fights do not happen here, they are just not allowed by the vast majority of its citizens, and thank God for that! The ugly, resentful, food denying mentality of a very few, becomes lost and ignored, in the seasonal cornucopia of tons of total food shipments.

Our food donations do fluctuate up and down, and we have our full times and empty ones, but generally, food boxes are always available every few days, and few if any poor or homeless that I know of, die from starvation, but some must I am sure, experience hunger on a regular basis, due to disruptions in daily living, which makes them more susceptible to the cold winter weather. Proper hydration, having a steady source of fresh drinking water is equally important to health and combating hunger, and can be a problem for displaced homeless persons.

It is true, that citizens of Eugene, are those who eagerly arrest anyone who abuses or neglects horses, dogs, cats, etc., but refuses to do the same to those responsible for the abuse and neglect of its real human citizens, shelter needs.

But the homeless are still blessed to live here, because food is plentiful, and leftovers are processed and frozen, and food is collected by mail carriers, and good, leftover food should not be wasted, it is believed, rather it should be recycled, not simply thrown into a locked dumpster to rot, in the faces of the hungry homeless, living on the streets!

We have a wonderful, organized, multi-agency food bank system, here in Lane County, and a thriving farmers market, and growers market, supplied by dozens of local, family farms; and many grocers and bakeries that provide day old breads, etc, community gardens, several church kitchens, food pantries, the Eugene Mission, and some very generous, anonymous donors.

The only question then becomes, can all of the hungry homeless people get to this food and make use of it, at least two or three times each and every day?

For Thanksgiving, the whole community joyfully, and with much advertised, in-depth, media news reports, annually atones for their willful neglect of the needy exposed to year round weather, with a hearty, delicious, turkey dinner with all of the trimmings and clothing giveaway, that serves well over 1,500 low income and homeless singles, and families with children around the city area; it is lovingly organized, prepared, and served, by an army of hundreds of friendly, dedicated volunteers, in cooperation with the Culinary Arts School students, of Lane Community College, each and every year. This year marks the 21st. dinner event.

It is a huge feast, that serves many in one day, and is worth the waiting in line; everyone gets a number to keep order; and for having the donations of gloves, socks, hats, blankets, sleeping bags, and other winter necessities that are passed out, along with hot coffee, hot soup, snacks, delivered while waiting for dinner.

Bon-apatite, and Happy Thanksgiving! I myself usually attend this dinner and will do so again, this Thursday!

The false deification of law as justification for laws against vagrancy borne of poverty by Anatole France’s oft-repeated quote has become as repugnant, outdated, untrue, and irrelevant as the quote itself–for one thing, no one needs to steal a loaf of bread here, not even while living under a bridge!

In spite of our shameful, majestically secular humanist laws that seek to forbid only the poor and homeless from sleeping or being in places not meant for human habitation, for it is only they, (not the well-off) who cannot afford to rent or buy a nightly room, or any place meant for human habitation, the homeless will act to the contrary of the public, as the lesser choice of evils.

Homeless humans, will act according to Maslow’s Hierarchy of Needs, and no selfish, self-serving, man-made law but the natural creators law of the human individual’s will to survive, shall ever prevail, fulfilling the need for water, food, shelter, and sleep!

To be punished for doing what is every homeless persons rightful, willful duty to meet these needs, is cruel; is to be personally assaulted and violated with the most condemning social, civil decree or curse to suffering, sickness, and eventual death. Is this the intended consequence? An end to homelessness by attrition? One who is caught in such a position over time, can not help but believe that this is true.

No self-respecting homeless citizen with a backbone, who lives here in Lane County should have to take this abuse of corporate authority, or the confiscation of personal property such as food or the means by which to use it, or by impounding the vehicle which contains it, without seeking immediate legal assistance, and demanding due process in court, for the swift return of all necessity items taken if any, according to State ORS law, and specifically:

H.B. 2482, “Relating To The Removal of Homeless Individuals from Camping Sites on Public

Property”

that requires storing said items for a minimum of 30 days, if they bother keeping them at all, for the owner to retrieve.

The State of Oregon should be pressed to make it an equal crime of “fraud, waste, and abuse” of any, and all AFS food stamp purchased food items, that are wrongfully taken (confiscated), or disposed of, from their rightful, purchaser/owners, in the 24 hour enforcements of illegal camping ordinances by any local, county, or state authority, which leaves the homeless person suddenly, without a place for the self-sufficiency of a personal food supply, as well as the utilities and cooking equipment to prepare and heat it. The 24-hour deadline should, it is strongly recommended by the ACLU, be increased to at least 48 to 72 hours, if no other violations are found.

The State of Oregon should also be pressed to immediately place its homeless residents (citizens) under the very same kind of ombudsman system of rights that state residents of nursing facilities have, to outlaw at the state level, homeless harassment, abuse, neglect, exposure to extreme weather due to sudden enforcement, forced isolation, sleep deprivation, or forced hunger, due to constant disruption, or relocation in relationship to sources of food and water.

The City of Eugene promotes food security for its housed citizens. The City and the Mayor has some time ago, released a statement in support of, and responsibility to advise its housed citizens, and families to keep an emergency supply of blankets, water, food, cooking utensils, fuel, first aid supplies, medication, etc., on hand in the event of a disaster.

Well that’s fine, everyone should have an emergency stash on hand, if possible, but isn’t that a bit hypocritical and insensitive towards the homeless? I do hope this was was an innocent oversight, because our mayor should see the double standard, and have then and there, thought to herself, “What do I tell the homeless, who have little or nothing on hand, no safe place to keep stuff, or recently had their car, van, or motor-home with all their cooking utensils, and food inside, towed away–quite possibly from Eugene to Springfield, for illegal camping?”

Look into the eyes of the many homeless people here, who live from campsite to campsite, food box to food box, from dinner line, to dinner line, what do you tell them? Be sure to have your emergency supply ready in your closets, too?

No, it’s more like–oh, here’s a list of all of our services, because it’s illegal to camp here. Here is a couple of useless phone numbers as far as shelter for tonight goes–but just go to the Mission, just go eat here at this church, or go there to get food boxes. How can any one not see that this is not food security for the homeless, but food insecurity, and a recipe for hunger! That is the unfortunate, police policy (pathological policy) we have here; a real rotten, dangerous, adversarial situation for many of our local homeless, who cannot make themselves invisible enough.

Food is vital to an outdoor living, homeless person, because it takes food to generate heat to maintain core body temperatures to prevent hypothermia, and to prevent overheating from heat exhaustion. But cold temperatures, getting clothing soaked by rain or snow storms makes food gathering very hard, keeping warm becomes a priority. “In some areas, your need for shelter may take precedence over your need for food and possibly even your need for water. For example, prolonged exposure to cold can cause excessive fatigue and weakness (exhaustion). An exhausted person may develop a “passive” outlook, thereby losing the will to survive.”

But what about the future of our food security?

Our dependence on cheap oil and a steady dollar, means that future food security for us all, is just an illusion, and this truth will soon become evident when, not if, the US dollar collapses, or is replaced by another currency, and food quickly, as in overnight, disappears from supermarket shelves, as the wealthy begin to hoard food by the truck load, while what is left on the shelves will be unaffordable to the poor to buy, with their worthless dollars. None of us can predict the utter chaos this will have on our local economy and community. It will drastically affect priorities as to who, where, and how food will be acquired, and who shall receive the food, when, where, how much, or how often.

Emergency food storage is and should be, the concern of every state, including Oregon. The recent banning of Willamette Valley’s grass seed farmers from future burning of their fields, has many of those farmers turning to wheat. & My Thoughts About The Pathological Bias Against It, In Law and Journalism

In today’s New York Times, there is a significant news announcement from the Obama administration’s Justice Department. It is a new policy which re-affirms and makes it abundantly clear: Patients and their suppliers who abide by the regulations of their states medicinal marijuana laws, will not be prosecuted.

We shall see. That was the promise made previously last year, but I saw story after story, of California pot dispensaries and patients, that were being raided and arrested on the premise that they were fronts for illegal sales of marijuana–well duh! They are tightening the borders of America so tight that we smokers can only get “home grown in the USA”!

It is potent, and sticky with plant resins and THC, which is in itself, a health issue in that, much less is needed to be smoked, for relief. That is the truth which every experienced user will attest to. That, however is not what is being told to the public, it is rather told over and again, the misstatement of fact that having 20-30 times more THC, it’s far more dangerous–fear, fear, fear!

And not surprisingly, there is mounting pressure and temptation to grow it for profit, because “its the economy, stupid!” and there is a huge market of determined Americans too fed up with the “war against intelligent drug use”, and the locking up of more, and more citizens in prisons for this unique plant, which is always referred to as a “substance”, an “illegal substance”

As if we are not literally swimming in a creation soup of substances upon this earth! Didn’t mankind catalog the fauna and flora, and all the elements of earth, long ago? Have we simply handed over to the nation of nanny states, our entire English language to pervert and con-volute into meaningless slogans by lawyers, politicians, police, and reporters? I do believe we have!

WTF! Call it what it is, not what you have wanted the American people to swallow all the years past, which was not based on medical science, but “pathology politics”–its called Psy-ops, or psycho-political, propaganda!

Example: “all illegal drug use is abuse”

That is the core brainwashing slogan which has been used ad nausea in a looped, repeating lie. We are being programed for the criminalization of all natural human attributes, which our government’s presidents and drug czars, and their Fed overlords long ago, conspired to do.

It was to flood this nation with all kinds of drugs (other countries did this to us also, as chemical warfare) by using the CIA, first to profit and fund the Iran-Contra War, then in order to declare a future war of tyranny and imprisonment, against “the weaker elements of society” who would naturally, and stubbornly, use these drugs in deference to the laws against them.

People, wake up! Listen to what these drug war-mongering bastards are going to continue to say, using fear, and your child’s endangerment, to influence you to conform–they want to continue to put you, and your children into prisons for using, growing, or selling marijuana, rather than losing their jobs, and their authority to rule by ever stricter laws, as a giant PAC (political action committee) against the wishes of the American people, state by state! That is the the other side of the pathological bias which is not being debated, as a matter of policy.

Listen to what the screaming, anti-big-government, blowhards who are today steadfastly denying the uninsured health patients of America, will tell you about the harmful effects of medial marijuana; but also, keep in mind their drug-pushing, pharma, and some of their listed, dangerous side effects, and watch everyone rush to a natural, green plant first, when given a choice! To us it is common sense, to them it is a behavior trap used to identify, and incarcerate.

Those who still continue to cry, and complain about all the crime marijuana is supposedly solely responsible for, constitute a perfect, text-book example of group-forgetfulness, group-ignorance, group-hypocrisy, and group-bias, towards the past history of the prohibition against alcohol during the 1930-40′s, and the organized crime it spawned, everywhere. Let them cry and complain, alone! Aren’t they just as much to blame, if not more so?

We will, we will–tase you!

First of all, I would like to shock you awake from a few of your illusions, if that were possible. There are good laws, and there are bad laws; just like there are good cops and bad cops, good lawyers and bad lawyers, good politicians and bad politicians, etc.

Another illusion I wish to destroy, so that it not bind you to eternal ignorance, is that we damn well do torture! We worship the torturer like a God, and the right to torture–sacred.

We love torture–torturing others, that is–we approve of it with our indolence, our silence, and our passivity. Hollywood glorifies and glamorizes it in its movies, and with TV shows, like the show “24″ in particular. We support it, we vote for it, and we demand it, from the highest levels of our military, and federal agencies, to the very local level, every time we arm more police officers with tasers–aka, conductive energy weapons!

Admittedly, we have some of the most ungodly technological weapons, and instruments of destruction, military and civilian, individual, and totalitarian, mass population control, ever devised by man to do it with, not to mention the A-bomb, which could set us back to the stone age (where we might be better off anyway).

Look for more and more of these hideous misuses of technology to be used against the populace, as unrest grows over the failure of the economy, and wars again, soon.

Another illusion I wish to explode in a shower of sparks over your heads is that, it will never happen to you. It may, or it may not; do not count on your needs, status, or your reason for resisting, or protesting, or simply being an innocent passer-by. These justifications will not save you from the cattle prodding, tear gassing cowards, behind full combat uniform in your streets. You have no idea yet what is to come, citizens of Eugene, nor where it shall come from.

Oops! Sorry, we didn’t mean to shoot you–we meant to tase you!

Admittedly, there are a few lucky people here in Eugene who are alive today because our police now use tasers; and there are other people who would be alive today, had the police had the option of tasing them, instead of shooting them dead.

But what really pissed me off is when I heard that no officers are required in training themselves to be tased for the purpose of knowing what it feels like. That is so cowardly, and these guys are to be given free choice in their use of tasers against the rest of us? No, we don’t torture!

Although I personally have never witnessed someone getting tased, I have seen two incidents here in the park I live in, where police have had their tasers drawn, aimed, and ready to trigger at someone, before they even came out of their doors; and in both cases there were other circumstances that probably justified using caution, but not with guns or tasers already drawn, and ready to fire.

When You Are Homeless, It’s Priority One!

What is a priority 7 Call? “Calls relayed to Public Works.”
Well, it does not seem like I can claim the homeless are a very high enforcement priority, yet it sure seems like the EPD is very efficient as to answering its complaint calls, and service patrols–and they are. Either way–priority or efficiency; the homeless trying to survive in Eugene, are always open season for violation hunters, both public and private.

Persons questioned by police as to how long they have been there should never admit they are camping, and always insist they “just got there”, unless they found them there previously! Of course if you’re like me, you’d want to say, I’m homeless–ya, so what? Alas, those were the old days.

Or if they feel as uncomfortable about giving false information to the officer (with all their visible camping gear as evidence) as I would, it is best to simply “take the 5th” amendment, so as not to incriminate themselves.

Never admit guilt in these cases of illegal camping, or that you are homeless. Best to play dumb and say nothing–which is very difficult, and takes more discipline.

Give them as little information as possible–remember that the preponderance the city may/will use to make their accusation of a violation against homeless campers, needs very little evidence–it’s borderline hearsay–and I must add–heresy!

Just smile and shrug your shoulders until they leave. Also, be absolutely sure to ask for each of the officers business card, the housing assistance hand-out, and citation if received. Don’t lose them! Consider contacting the local ACLU, and requesting legal assistance and request a court trial to prove innosence.

Be nice, don’t be the first homeless person in Eugene to get tazered!

While Eugene’s illegal camping violations against me are so far, failing in District Court in my favor–four have already been dismissed including one double jeopardy decision, thanks to my pro-bono attorney for catching that one–but now, the city is attempting to misuse another ordinance ( parking control) against me, illegal storage on the street.

Nice try, guys but you looked realy stupid trying to tag my motor-home bus as an abandoned vehicle, when I am living in it, and doing it at 12:00PM noon, while I was inside eating lunch, you were chalking my tires!

I have been parked at 4th & Madison (the same exact area as illegal campers listed above in this report are being visited upon) for 26 days–I told you, I’m not easily moved–but at this time, I know, when it’s time to move, it’s time to move!

As a reasonable person, viewing the universal illegality of homeless camping options, I decided that it was obviously the city government gatekeepers’ intent to completely seal out of the community, all of our homeless citizens.

By refusing to provide any possible legal shelter or camping alternative location for them, in order for them to comply with the law, it therefore, really did not matter where or when one might choose to park (camp), it’s all the same penalty; therefore I parked where ever I felt I needed to be (for my safety, privacy, and convenience), not for anyone else’s!

The message I seem to be getting, perhaps is that after being clobbered for camping, being told I can’t camp; now they’re saying to me that it’s okay to camp, but you just have to keep moving every so often.

Under normal circumstances, this order to move would not even involve me, as I would have been out of here long ago were it not for my bus being dead-in-the-water. The engine will require being rebuilt or replaced (which I did replace by my self–while parked on Maple St. & Roosevelt Blvd), also totally illegal to do, according to city code–but that was not my problem, either. It had to be done.

On day 28 at this location (Madison) 5-18-97, Public Safety Officer’s Julie Boyd and Officer Clayton stopped by to see if they could be of some assistance. I would have preferred to return to the Eugene Folk Festival, that evening, but these two officers offered to help find a tow truck for me, as I told them that I really did wish to move, and that I had a place to park it off the street.

I explained to them “our” dilemma that “we” faced in solving this problem: that, if I was unable to hire Ray’s Towing, the City would be forced to hire them, thereby compounding “our” losses and expense, and depriving me of my “home”, and belongings, etc., plus surely having my attorney involved in further litigation with the City over such matters.

Officers Clayton and Boyd understood the situation, and that I informed them of my recent acquittals for illegal camping charges.

Thanks to these two EPD officers, who made a few phone calls, and had me hooked up with C.J’s Towing for what I could afford. They asked how much I had, It was $40.00 cash, and I got moved to my next unknown adventure, for I was having my bus towed onto some one’s private property with no permission–totally trespassing–those officers had no idea where I was going!. But I managed to get away with being at that spot for 3 days, before scambling around in a nearby supermarket parking lot, having to look for any one with a strong pick-up truck, willing to tow me to the next place for gas money.

Tomatoes Do Grow Better Upside Down!

This summer I decided to experiment for the first time with upside down tomatoes like seen advertised on TV using instead, a 5 gallon bucket for greater plant growth.

It really works! The young tomato’s leaves will automatically begin curling upwards once the bucket is turned right side up and hung by handle.

A small plastic collar is fitted around the base of the plant to keep dirt from falling out of the hole, while leaving excess water drain.

I may have gotten too late of a start on my garden, because we had an abrupt cold, rainy ending to this Oregon’s summer. It is not over yet however, tomatoes are still ripening. Yum!

This horrible, random incident has taken the town’s mayor, Mayor Kitty Piercy and the Chief Pete Kerns, of the Eugene Police Department by surprise, and into another round of re-evaluation of current enforcement, and hopefully successful investigation, to find the perpetrator who allegedly, set a homeless and capture of the person on fire, in the down town area.

The question as to how to make downtown safer, because it is clearly not, has become the number one priority again, as now another act of terrorism becomes breaking news.

I think I may use that term here, correctly, terrorism; there is that ugly word again, as if we have not already heard enough from the “war on terrorism”, and have begun to grow weary of it. Its about our mental confidence, about feeling safe after witnessing others being hurt or killed–or not. Ask the homeless downtown if they would consider such crimes against them, as instilling “terror” in their minds.

The city’s recent, “exclusion ordinance” was a reaction of frustration to several downtown crimes; except setting homeless people on fire was not one of the offenses included link:

The new exclusion law is no better than the sweeping loitering laws of Portland; a more focused approach to first time offenders, who may be just innocently minding their own business, or guilty of something–its where illegal searches happen.

The ordinance is sure to remain, as all ordinances do; if not soon modified, amended, and beefed-up, territorially or punitive, as a zero-tolerance solution to continue enforcing safety, in an accelerating world of instant image and random acts of chaos.

But will it make a difference–will it catch those who harbor multi-hateful, violent emotions, which cannot be seen until they are impulsed to act out upon the innocent? I don’t think so.

Excluding a first-time, repeat homeless camper, caught sleeping, eating, or peeing; or banishing the indiscretions of a non-violent fool, for his foolishness, was not the reason for the new law. Lets keep that in perspective.

It was a loud, public outcry; a mandate in favor of exclusion of the worst offenders; it was example, after example of public testimony about blatant, rude, drunken, menacing, harassing, racist, disrespectful, and violent behavior.

It was for those who clearly were uncivil, or posing a threat of harm or theft. When I saw it, I did not support it at the time, most everyone else believes it has become necessary–but unfortunately, these types are not limited to downtown.

Where will the good people, the gentle people, the unassuming, trusting people, the innocent man or woman walking on those streets, turn to, but each other for safety and a sense of familiar faces?

I am opposed to all sweeping vagrancy or loitering laws, however well intended or well meaning, that serve to discourage gatherings of any size, friendliness, or back round; and it encourages isolation of the individual from society; therefore increasing the “fear of the unknown transient”. What’s wrong with knowing your homeless?

This makes everyone seen downtown, a suspect of all kinds of trivial, non-violent, crap; in a nightly culture war, of wasted enforcement manpower, when we are probably only looking for a loner type person who apparently committed this crime.

The homeless citizens here 99.9% of whom want very much to obey the laws, (and have a job, and pay their own way), yet cannot, who would be just as willing, and as good of witnesses for the police in an emergency as anyone else.

There is a high number of public drunkenness incidents throughout the city, the police report. Sadly, social drinkers over time, often become chronic alcoholics from the experience of homelessness; many have given up, and given in to alcoholism, which is not only a disease, but also the presence of multiple, disembodied, alcohol spirits, occupying a drunkard, like a parasite and attempting to feed their own addiction, with every sip of fermented brew, he or she takes.

So, this one person frustrates and outnumbers even the most well trained police force; and a deeply concerned, and a visibly angry Mayor, who wastes no time, and takes very seriously her all-embracing, everybody-in community , leadership, and reasserts for the entire community, that this behavior will not continue, and that the City will not stop until he is caught. Amen to that.

This is the SOB that rightfully should be excluded from downtown, and from all of Lane County, for life! But instead, he remains at large, nobody knows yet, who he is, maybe he is with no group, who never heard him threaten to harm a homeless man, who would turn him in, in a N.Y. minute.

There needs to be more people down there on the streets not fewer! How often I have watched as some dead end street or road was being used as a dump; or a place where stolen vehicles are taken and stripped, then burned or the like; and of course, never enough police or sheriffs–never could be. Not supposed to be.

There could be–but will not be–a small, tight, three family, group of homeless campers, given permission, sanitation, “vetted” by St. Vincent dePaul, or Whitebird, whose duty it could have been to call in (on a donated cell phone) anything suspicious, or for personal, or medical emergencies, in certain places to do just like any other community volunteer. However, there is too much opposition the expansion of the program to include those of the very type the people already cannot stand downtown.

When a small group of friends band together to watch each others backs and belongings, there is a bond of trust and honesty that ought to be seen as an obvious help to the greater community, as “neighborhood watch” of the streets of downtown, instead of simply being declared a public safety hazard or nuisance.

Unfortunately, at Broadway and High St. is not a suitable camping area–it is a business district. There was no one else around at 3:00 AM in the morning for witnessing the crime allegedly committed against Mr. James Lemmon, the homeless man who is now in a hospital, recovering from his coat being set on fire from behind.

There cannot be total surveillance except by building the hideous, near total Orwellian, “big brother” atmosphere of the United Kingdom, with thousands of video cameras covering nearly every square foot of London, total visual monitoring and identification of every individual in public.

I wrote an extensive piece on video surveillance in an earlier post, and it was posted on KMTR TV, I wrote a lengthy comment covering the dangerous bicycling conditions in Eugene, and use of cameras to catch hit-and-run crimes.

We are beginning to really know, under no uncertain terms, that no one is safe down there at 3:00 AM, or 5:00 PM, and therefore, at any other time; as the recent assaults and murder of another homeless man shows.

Eugene’s reputation as a safe, friendly, progressive community has again, suffered a setback with another crime in string of violence outplaying itself over past weeks and months, in fact years.

I do not write this piece as, an “I told you so” statement, it is a fact. It is not just a local problem, street violence is a national disgrace, and an economic phenomena, that people refuse to see the symbolism behind–which is simply–social breakdown. Warning! Danger!

Anyone who must be in downtown or anywhere in Eugene at odd or even hours, should be either in the friendly crowd of Saturday, or Farmers Market, or be incognito, with full lights at night, on a very fast bicycle, zooming by everyone.

This crime, further proves there is an attitude of hatred and violence out there, that has infected these kinds of street-roaming monsters even more beyond my own comprehension to warn city officials about!

Here is another point I would mention. Here is guy who’s whole left side was burned, and his left arm was in a cast, said to be almost totally burned of skin; he himself, might probably would never so much as hurt a flea, becomes the next victim.

Mr. Lemmon is homeless, and he is also black. Was he at any greater risk of either racism, or class-ism–how could the attacker see from behind his skin color or know for certain this guy was homeless?

Could not this have happened to anyone? Until the criminal is caught and decides to tell why he did it, we may never know.

Was it just the angry, deranged mind of some young punk who thought he saw a non-human target to rage against–with a vial of gasoline, and a bic lighter, ready to torch the guy?

When we consider how this fire most likely needed an accelerant, that is considered a premeditated act?

In most all of my missives to to the public and government officials, I am speaking in advocacy for the homeless in general, and for future (perhaps your children) in jeopardy of homelessness, in particular.

I talk about a negative attitude towards the homeless which is way more subtle, almost unseen or unheard, it is so carefully framed, or it has become so politically or openly correct, but it is not the truth, and it offends the homeless, it defames them.

It is a systemic problem of governments evading responsibility for protecting a minority, and misapplied civil law, and the unequal economic, and legal representative factors, which are never in favor of the poor, but always in a light, most favorable to the corporate, and the elite of Eugene, who champion more acceptable examples of success, and role models, often seem the most willing to rob them even more–to the point of having nothing!

The anti-homeless attacks I strongly oppose are those where the city neglects to provide enough legal places; then harasses, and then encourages public or private land owners to maliciously tow the vehicles of homeless campers and all of their belongings, leaving them helpless to help them selves.

That is one kind of insidious hateful, attack upon the homeless community over the years, that is much “approved of”, but only deserving of someone like the A-hole who set this guy on fire.

I would also have my readers know, that I also suffered a violent attack several years ago (about 1995-6) while living homeless in my bus, on a dead-end street of West Eugene, at the end of 4th and Wallace St. late one night, by a drunk, who stuck the barrel of a .22 rifle in the back of my neck, which I grabbed and shoved away.

I tried to run, but could not; he repeatedly punched me in the face and pulled huge clumps of my hair out trying to drag me from my home, while I had my left arm locked through the steering wheel and I was trying to block my face; I was left with a broken nose, both eyes blackened, and an extremely bruised, and swollen face, and still, in the so-called, low income-friendly community, few even knew how I was assaulted and left to the streets to suffer and cry, like a worthless piece of roadkill.

I was forced to have to drive my own motor home, half blind, in a state of bloody shock, to a nearby friend’s apartment, 3 miles away, at four corners, to call the police, and be taken to the emergency room at Sacred Heart Hospital.

So, I know all too well about the dangers of city life here. If it isn’t by street thugs, it’s getting run over by vehicles, while riding your bike. Eugene personally, or impersonally, is a dangerous place to live.

This past incident, was a sadistic act of hate against me, which I bore alone; but then, for calling together other homeless to teach the advantage of safety in numbers, parking in groups, we all were dispersed, like hated Gypsies.

Our Mayor said it best–this latest was a sadistic attack–and I would add, there is a very sick, anti-social individual out there still, and this really is a threat to all citizens, homeless or not, and I fear, will be more difficult to catch!

It was during the last days of the battle to support and defend the most homeless campers possible, using remote cul-de-sacs along W. 7th, in Eugene in a “circle-the wagons fashion; and one evening as I was taking pictures with my Richoh 35mm. camera, at the entrance of Nolan St looking into the camp.

Suddenly, this small sedan with four unknown men drove up, and was about to turn into the street in front of me, so I readied to get a picture just in case. I saw one man through the rear window raise something up to just the bottom edge of the rear window–it happened so fast, I almost missed it–but I also felt or “saw”, a like strange flash, or blink; and at that very instant, inside my brain!

Upon receiving back from developer, my film and upon opening, almost the entire roll of pictures were totally washed out with red/yellowish colors, and I instantly suspected it was caused by some kind of radiation from that object that when triggered, would cause damage the unshielded film.

Several years later, I am able to Google for any small, portable devices whose radiation might ruin photographic film, I came across radar gun data, and I felt almost certain that not only was a radar gun aimed at me point-blank, and at the camera hanging from my neck, but that most likely, I had caught four plain clothes officers coming incognito, to visit our camp for the purpose of spying or instigating trouble, on our campers. It becomes more obvious, that since only they carry them, those guys came prepared for evidence destruction!

I had stumbled upon perhaps a well kept secret, known only by police within law enforcement, that there is more than one use for a radar gun, which is designed only to check the speed of moving vehicle.

For the Reality-Challenged:

Lest no one forget: I have been there, and I believe that the homeless and the concerned citizens of Eugene and Lane County, deserve, and would greatly appreciate, an explanation as to why, after nearly twelve years and several successive program manager/parking facilitators, and (R. W.) from City Housing, and their agreed upon collabrative homeless problem-solving effort, consisting of SVDP and the City of Eugene, still only have ten spaces for Eugene’s homeless?

It seems that only adding more rules, (some being necessary, I would agree–but, with compassion!) that eliminate, by the “raising of the bar of qualification” of more homeless from entering for the program in the face of no available jobs for them, seems to have been, over the years, one of their most important goals.

One of the listed duties stated in SVDP’s Parking Program’s job description sheet for each program manager, is the responsibility to: “recruit new parking spaces” from churches, city, county, local business, and non-profit organizations, i.e.“public entities”.

I believe we would all benefit from knowing how many new spaces (and the fewer complaint calls it generates!) for Eugene’s homeless campers–who are facing another cold, wet, winter–that Mr. Wienman, and SVDP’s program manager can successfully add by this winter, and if there are any new City goals that have been made to increase the amount of spaces, proportional to the increase of homelessness, and so too, the county. After all:

The applicant campers must submit their written goals for more stable housing–basically, by having to answer the difficult, if not impossible question: “Where do you see yourself in 90 days?

This turns the definition of “triage” upside down on its head!

Instead of listening to the campers asking SVDP, AND the City and County: “what other options do you intend to provide for the homeless citizens who would otherwise reside here, who receive their services here, now that you have been given some federal stimulus money; now that our 90 days are up, and there are still no jobs for all of us.

Foreclosures are still dumping more of us on the streets, the high unemployment rate has no end in sight for labor, we must compete with dozens of other more qualified job seekers, our credit or back round is ruined, our work history and experience may be outdated, some get rejected by age discrimination, but can’t prove it, were such a job available; and we still cannot afford to rent; because the first, last and in some cases, a required double deposit (for poor credit) is just too much for us to have in 90 days!

Please listen to me, all of my lovely, local TV news reporters: Remember, the homeless no longer may afford the luxury of watching television, as they have been left on the other side of the “digital divide”. What ever you report or say about them, will always return a backlash of public opinion against them, they will not hear or know about; what is being reported, and will be unprepared to appear any differently. That is not fair, or balanced service towards the furtherance of unity, or of community wholeness.

Do not refer to the homeless as “illegal campers”, or “transients”, from now on unless they were actually cited and found guilty in court as such! They may not have physical, but all have local, mailing addresses. Broadcasting these inaccuracies as to personal innocence, and other pejorative references has done great harm to all innocent victims of homelessness; and demonstrates a lack of community connection, and journalistic sensitivity, respect, or truth; while their usage promotes more unnecessary negative perceptions, and attitudes towards them.

These homeless are being persecuted as “willful violators” for their will to live peacefully and safely, just like you would; and because they are poor Christians i.e. “the poor of Christ”; who love the Lord, and the City of Eugene; and by law, they have every right to remain here!

And you yourselves know, that were you to be caught in the same camping situation, because you are a woman, because your own personal safety is of utmost importance and risk–and it would certainly be, in light of recent
anti-homeless crime; you would be deemed to be in imminent danger
of a threat of violence, assault, or murder.

Therefore, choosing the “the lesser of two evils” by sleeping in your locked vehicle is, the choice you would no doubt make.   It is defensible according to the City’s own previous dismissal of a prohibited camping violation against a homeless defendant for that very reason. Because it is in our state constitution: ORS 161.200 is a law, which specifically allows and upholds such an argument, as a “necessity defense”, in court and is recognized as one’s legal right of personal protection.

Lets get real. If selling the idea of allowing more campers to park with those mentioned property owners and agencies is not very productive, or difficult to find these days, it should come as no surprise, because for many, many years, the local media, and police, have done their best to pro actively frame, scapegoat, miss-characterize, and profile the homeless and beggars as troublesome “violators”, or “transients” who then, are always condemned as a “public nuisance” by the City, at the beck and call of service, duly dedicated to every complaint; that is malicious enforcement!

There is a strong anti-homeless attitude here, by the greater business community against the poor; for reasons purely related to convenience, appearance and profit. It is nurtured by extreme, right-wing, media demagoguery, only to create more scorn in a continual, malicious cycle. And it can be roughly measured, I believe, by the disturbingly significant number of voters in the recent mayoral election, who voted against Mayor Kitty Piercy.

This is the underlying problem as to why the homeless parking program is such a hard-sell in this so-called “community”; which dwells in the divisive, hateful, darkness of conservative broadcast monopoly; ever since the more tolerable, truthful, progressive, local talk radio station, KOPT 1600AM, was silenced.

Don’t look at, or feel sorry for those homeless people! (Don’t look behind the curtain!) Because you may begin to see the truth; and wonder what is going on with the government, banks, and economy, and begin asking yourself, or to suspect, if this is what will happen to you, soon! See them all as lazy, or having character defects, or mental illness, which is why they failed! Look away! Don’t panic, they are not the dead miners canary, look away! Here, here’s our number, call us if they cause you any inconvenience or distress, we will come and take them away, if they refuse to go away!

The present, inadequate expansion or stagnation, or operation for the sake of mere perfunctory fulfillment, of our national show-piece of a homeless program, is not an acceptable service which leaves others to be left to die; or to be given only “emergency” overnight shelter at precisely 32F or below freezing–but not one single degree above!

Nor, will the city’s announced, “ten year plan to end homelessness” ever be more than a farce; never be able to catch up with, or meet its goal, unless more is done sooner, not later–yet, I realize the limitations of money, charity, and the hesitation to commit to allowing an unknown homeless individual(s) to park on someone’s property. You will never escape random incidents of stupidity from the few, but why give up on the whole?

The cost of sanitation, security, etc., has been expensive, but all humans produce waste.   Because a few uncivilized, problem campers in the past were found to be too much trouble, is why now, so many potential benefactors, are washing their hands of helping the homeless; that’s a big reason. However, all are deserving of shelter, somewhere–that must be the ultimate goal. Otherwise, we’re right back where started years ago–where are they supposed to go?

I am addressing you now, Lane County Commissioners; it’s time for you to do more to help Eugene and it’s homeless; who has been doing as much as possible, given tight budgets, to help the homeless with shelter and parking, for twelve years–

What have you done, except use land use and zoning inspectors to throw people off private properties, thus, making them homeless; after threatening their good Samaritan homeowners with $1000.00/per day, fines for being too compassionate! When government provides parking for the indigent, its always hugely expensive; when homeless campers do it, its free. Closer to which cost now, would the taxpayer prefer? Hint: Doing nothing is not an option!

What about the “Yurts” that were approved by zoning and land use legislation for use for transitional housing? Perhaps you might consider using some of the stimulus money for one, or several, county-based, small, “yurt villages” or heavy duty tent cities.

Did not officials from Eugene travel down to Maricopa County, California, to view their infamous tent camps for prisoners? Well, you gave us 84 new indoor jail beds, how about 84 new parking spaces? Why not do something for those starving for legal shelter here, without vehicles or RV’s; or for those whose 90 days has expired, so that they can get on with their life. This might help to increase turnover, lessen the wait time for SVDP spaces, and will take some of the population pressure off the Cities, as long as some campers may prefer, and can exist out further in the county, still with ease to services. Lane is too big of a county, to excuse its self from accommodating its homeless.

I am also critical, as I have always been since the days of the Centennial Car Camps, of the ruthless, arbitrary, 90 day “back-to-the-street” limit, which cost some to suffer devastating setbacks, at just the wrong time!   Where are the “next level” of transitional goals and plans for helping those whose time has expired, towards “affordable” housing? I do not expect to hear everyone singing “Oh, happy days are here again!” 90 days from now, or any time soon, do you?

In fact, the worst may be yet to come; to the extent that it would be increasingly incumbent upon the City and the State, to show cause and compelling interest in, the withholding of leniency towards homeless campers, or else face the inevitable certainty that they will find themselves facing the ACLU in court to defend one of them, and losing the entire ordinance. Better to sever it’s illegal parts now, than risk it all, right, Mr. City Attorney?

It is time for the rethinking, and changing of this “dead end” policy of shelter assistance, or shelter-sham; and ignoring the shortage of available living options, to reflect the economic realities of today; and the social, moral, and spiritual duty to face them; not simply with empty promises, or lip-service; because the term “affordable” in housing is meaningless, just as meaningless as attempting to separate homelessness by cause; because “homeless is homeless” it does not matter how one arrives, when one finds them self broken and living upon the streets, that’s absolute poverty, zero!

I will dare say it, bearing in mind the presence of the Holy Bible in the courtrooms: lip service to the poor and the homeless, is lip service to Christ, and to God.

RECYCLERS: but could pay dividends to fund charitable projects
for the homeless by cities, businesses, and private organizations!

The cities should use some of the recycle money that is collected from these “Big Belly(c)” recycle companion machines to the compactor, to fund homeless shelter options, after all they’re taking bottles and cans right away from their poor by encouraging consumers to “feed the belly”; which leaves them even less income to scrape up legally!

There could be a silver lining waiting for those in need, because
“feeding the Belly” could mean recycling
to support food and shelter donations.

Watch this very impressing video from the manufacturer. There are acually two lookalike machines, robots I think fits their inner design–one that compacts trash–which is great for the cleanliness of the environment–I agree–remember the origional public ads of thge 60′s–”don’t be a litter bug”, reminding people to use the containers? The Big Belly ecourages sorting, a very important thing lacking in recycling

Then there is a companion robot–no pun–another big belly, that is for recycleables only; and assuming folks use each both properly, and assuming they are placed next to the trash compactor, as the recycle materials (I think it gobbles them one by one?) are worth money; but do not plan to reach in with an arm into the belly of the recycle robot to retrieve a can worth 5 cents! These machines are tough, and made to withstand animals

I am an advocate writer for the homeless researching big bellys, because news of them has reached Eugene, and it looks like a good idea that will happen, sooner or later as budgets tighten. It will have unintended consequences for the can & bottle collectors of the streets.

These machines, while good for what they are designed to do, will hurt homeless recyclers, who greatly depend on incone from cans and bottles found in open containers.

However, if used properly by public, the homeless (or gulls, pigons, etc.) will not have to rumage through garbage, but shouldn’t the cities give some recycle money, or savings to charity?

Although I am very impressd with their advertised advantages, I believe that since cities are in effect taking from, or encouraging consumers to feed the big belly, and keeping the poor from having them, that the scrap value of collected recycling should go to fund homeless shelter options.

“Give Back To The Homeless, the Liberty of Nature’s Calling, or Give Them A Proper Memorial!”

Yes, another rant by homeless advocate, Danielle Smith September 10-12, 2009

Back in Jan of 1991, a group of Eugene’s homeless campers (including myself, until accepting a care giving job in Lebonon, Or.), from under the bridge at Armitage Park, on the north bank of the McKenzie River, went to Salem, Oregon to seek redress from the then presiding, Governor Roberts.

She clearly, and distinctly replied to the assembled homeless citizens of Oregon, standing there imploringly looking back at her that, “the homeless were not the state’s responsibility!”

As far as I know, that disaffiliation by the State of Oregon from responsibility for the non-abuse, or non-neglect of its homeless citizens, still stands as policy to this day. It is certainly evident in its “no camping” laws.

Ironically, with the mentioning of former Governor, Kitzhaber’s possible reentry into the next race as state landlord, I am reminded of when he, along with the governors of several other states, issued a formal apology for their states’ part in the use of eugenics, and of “sterilization” against those judged to be unworthy, during the 1920-30′s.

Over the years, I have made a thorough study of eugenics as used in German society before and during the roundups of so-called “asocials’ just prior to the Holocaust, I am convinced that the term eugenics applies to more than just “sterilization”.

I have felt strongly that Oregon’s apology, mindful of the complete definition and story behind the use of eugenics in past history of the U. S. and German society, was not enough! It is well known that several groups of condemned minorities, were the homeless.

I say that those apologies were disingenuous, the state is still imposing eugenics policies as far as I am concerned, and did not go far enough.

And that in regards to the homeless who remain today as outcasts, with no legal representation, or advocacy, from either Salem, or at the local level, it was simply ceremonial in nature and,

Therefore, I must declare that the policies of eugenics are still being practiced today, in “sanitization”, by the use of the camping enforcement laws, which order “sweeps of homeless individuals, and the confiscation of their personal belongings, and the total life threatening stress which reduces life expectancy, and the disruption it is surely meant to inflict upon them, because they are idigent, and therefore undesirable!

Camping in a vehicle on the street is not permitted in Eugene. Overnight camping in vehicles is only permitted under the following circumstances: (1) Vehicles are parked in business, religious or public facilities’ parking lots at which they have permission from the owner. The maximum load is three vehicles used for sleeping at one site. (2) The owner and tenant of a single family home have invited a maximum of one family, using a maximum of one tent or camping shelter, to sleep in their backyard, or to sleep in a vehicle parked in their driveway. (3) Persons may also sleep overnight in a maximum of three vehicles on paved or graveled surfaces on vacant or unoccupied parcels with the property owner’s permission if the owner registers the site with the city or its agent.

In all three overnight sleeping scenarios listed above, the owner must provide toilet access, garbage disposal, and a storage area for campers’ personal items that is hidden from the street. Tents or shelters in backyards must be at least 5 feet away from any property line. The owner cannot charge a fee for overnight sleeping. The owner can immediately revoke permission at any time.

The city can prohibit overnight camping, despite an owner’s approval, if the city finds this use incompatible with the uses of adjacent properties, a nuisance or other threat to public welfare. Permission to camp on city property can be revoked if the person violates any law, ordinance, rule, guideline or agreement, or the use is determined to be incompatible with neighboring property use. (City code 4.816)

If there is a problem illegal camper in your neighborhood, you can report it to the police department’s non-emergency line at 682-5111. You will be asked to provide a location, vehicle description, license plate number if known, and any other pertinent information. If there are no extenuating circumstances, your report will be routed to St. Vincent de Paul’s (SVDP) Camping Liaison. SVDP works with the City to resolve camping problems. SVDP employees are the first responders on most camping complaints. They will work with the involved campers to resolve the situation without police intervention. In most cases this works. If it doesn’t, complainants need to call 682-5111 again, and let the calltaker know that the problem is not resolved. Uncooperative campers will eventually be subject to fines or towing.

What are they hiding?

You see, it all seems that a plan is in place to assist the homeless, so that no matter what the need, there is no excuse for illegally camping in the City of Eugene, when in fact, the only plan is the criminalization of the “many”, who remain without invitation, authorization, or access to overnight shelter, or legal place to park.

The city will deny this; the (city attorney, Glenn Klien) says “not per se” however the truth is, Eugene’s illusion of friendly, generous, compassionate ”community”, is hogwash that explodes upon first, if not second, and most definitely the third time the police find you; and afterwards, you find yourself holding one or several, expensive, insulting, prohibited camping citations in your hand.

Finding statistics on illegal camping is not easy. The daily reports (see: August 10 post showing illegal camping reports from daily newspaper), which were not available several years ago, do contain illegal camping calls for service, but no one knows who, or if a local resident (that’s doubtful near Wash/Jefferson Pk, or extreme W. Eugene industrial streets), or an officer on patrol, or a police “volunteer”.

Yes, they do exist, they are mostly retired; they are the eyes and ears of the police, though their full extent and list of duties are unknown, beyond parking lots–just like it is always unknown who initiates the complaint calls; and annual reports do not seem to mention illegal camping’s overall statistics-what little details there are, remain buried under, ”other”, or are to be found within the individual police reports, which can be requested from the department for a fee of $10.00

Perhaps this is why I would have had to kick them $3,000 for public records back then, because it would take an inordinate amount of time to find them, let alone gather them up! Perhaps it is time for the City of Eugene, especially the police, be called upon to keep detailed, accurate, collectable, and accessible to the public–records, and not bury them within
miscellanious data.

Illegal camping is given a very low importance on the city’s priority scale; it is not a 911 Emergency, but they do respond as quickly, because they “protect and serve” the offended, who are not homeless. They even had an “RDU” possie–thats Rapid Deployment Unit, that would send at least three patrol cars, with two officers each, for a single homeless woman–me!

That was overkill, that was a circle-jerk, that was harrassment, intimidation, and abuse, not to mention the inconvienence of being “detained” until they left!

One would think that

Under the headings of behavioral crimes and quality of life is where such details should be found, but since “illegal camping” is not mentioned in crime report statistics spreadsheets as a heading itself, it must be assumed to be included (hidden) under “other”.

Any statistics that are posted, if at all, will not reflect an accurate count of illegal camping incidents, anyway, because many such homeless campers, being caught on commercial, ODOT, or railroad property in W. Eugene, for instance, are given trespassing citations; this has the effect of hiding, or swallowing up a given case of illegal camping, for statistical purposes, merely because one is found on public property, while the other is found on private.

In other words, there are more cases of illegal camping than reported–but they’re not reported as such, but as trespass. Now you see it, now you don’t!

My search for statistics as
written by Karl Sorg, our paralegal, my witness as friend of the court, retired attorney, published in ‘okios #5 Winter 1997/98 pg 11:

Lane County District Court opinion on E.C. 4.815 (anti-camping ban)

“District Court Judge Eveleen Henry, after four months of deliberation, has issued a 20 page memorandum opinion finding Danielle Smith (defendant and appellant, ed.), guilty of two violations of the Eugene city “camping” ordinance (E. C. 4.815). The opinion is the culmination of a total of seven citations against Ms. Smith over a period of over two years. Another one of the seven citations was dismissed by Judge Henry for failure of the City to produce evidence in support of that citation.”

“Judge Henry’s memorandum addresses a number of constitutional issues which were raised by Ms. Smith’s pro bono attorney, Howard J. Anderson.”

“As a result of the citations and the city attorney’s reduction of the offense, the defendant’s efforts to get statistics which she alleged would show that most of the people cited for the offense of “camping” and for whom the citation had been reduced to a violation, are homeless people. The city’s response to the defendant’s discovery requests were that it would cost the homeless defendant $3,000. Because of her lack of funds and the offense having been reduced to a “simple violation”, Ms. Smith was unable to get the information that she and her attorney felt would have certainly supported her contention that the ordinance’s enforcement unconstitutionally targets indigency and not the performance of criminal acts. The ultimate fine for the violations was set by Judge Henry at $58.00 in each of the two cases.”

Excerpt from letter, pro bono, Attorney at Law, Howard L. Anderson wrote to me:

“In deference to the court, I recognize that we were not able to present all the evidence available on the issue. The city required more than I could afford out of pocket for the records needed to ascertain the pattern of enforcement. Additionally, with more resources we could have pursued the city policy of allowing camping without council action for specific events and by particular individuals in more depth. These may not have carried the day, but such evidence would have given a clearer picture of the plight of homeless individuals.”

And so, for your part in this matter: District Attorney Mark Harcelroad, Eugene City Attorneys Glenn Klien, John Kim, Judge Wayne Allen, Judge Henry et al, I say, Woe unto you, on behalf of myself, least of all; but most importantly, all of Thomas Jefferson’s “homeless children” America in the future, and made so by the banks, that you just betrayed, condemned, and kept illegal by case law!

You won this time, the unconstitutional camping ordinance remains; but not on the merits of fact, or truth; your ”preponderance” of evidence was hearsay, you produced no complainants, no signed witnesses (except the police, of course, just not the one who stalked me all over the place, phoning in complaints as a citizen!).

You delayed and denied me due process, and you had me once, in double jeopardy; why did Judge Carlson move to recuse herself at the most crucial time of my trial as being in conflict of interest with the City(because I was told, her husband, also an attorney, was known to be against the City’s camping ordinance!)?

You made obtaining evidence, supposedly public records, which I needed to support my defense, cost more than triple what I paid for with first, last, and deposit for the apartment I am presently renting!

And God only knows, what went on in closed chambers between you, and my attorney, which I was not privy to hear!

Question: Isn’t there a law against court suppression of evidence favorable to the defense (of a homeless individual), and wouldn’t it apply here?

What if the city purposely obscures its anti-homeless enforcement activities in its crime statistic reports, so that it cannot be proved that it only punishes those who cannot afford to “pay” for shelter?

I am described as a male to female identified individual (transsexual), who feels quite normal as a female, and passes well in most all public settings as a female.

I have posted over one hundred and twenty articles, etc. in this journal, and this is the first post which introduces and describes my trans gendered “second” life, and how I came to adopt it, going on eighteen years ago, now!

How I came to feel absolutely comfortable in this role from the beginning is a story of conditioning ones’ self to accept the uncomfortable; to accept the unthinkable.

However, its just not that big of a deal for me, really. I do not wish to seem narcissistic about myself–but hey–you did not see what I saw in the mirror, looking back at me one summer day, back in 1991!

I saw myself like I had never seen myself or thought of myself before, in my life. I saw what I might look like had I been born a female–close that is; I say that because if I was a woman from birth, I would be similar but much prettier, due to earlier estrogen presence at puberty, and the cultural/social conditioning which goes with it.

So, I got a late start right at age forty. Midlife crisis. Believe me, it is real, it can make you do things you never dream in a million years, you would ever do! But I am happy this way; it fits, it helps me cope with being single, (alas, it’s not a cure for loneliness), and being creative in my art–which is writing and photography.

It’s been nineteen years now, I’ve had my lovers from both sides of the gender line, is that TMI? TB! But I’ll NEVER stop loving or being attracted to women, ever!

The TV news reports say the Drain residents who have gathered , some who knew him seem to all suspect he was a victim of assault, while the sheriff maintains he fell and hit his head–I am not satisfied with that explanation!

What does Biloxi mean to me? It is another chapter of my past military life; I spent nine months in Biloxi, as a radio communications specialist student, at Keesler Air Force Base, graduating in June, 1985.

At that time, the locals were all still remembering Hurricane Camile, and they told me all about the tribulations that the town went through during that time.

The base, as I understand, suffered extensive damage when Katrina hit; but it has been rebuilding, and it is welcomed by the local economy as a tremendous boon to recovery.

He exposed the poor-hating Republicans for the corrupt, selfish, greedy, anti-American, working-man resentful capitalist pigs they are, while feeding at the government trough; and how they forever scapegoat, deny, and disable the working class and poor, right down, down the economic ladder, to unemployment, uselessness, and finally, some to their homeless graves!

As for the stupid sheeple, who believe all the Republican and corporate whores’ lies about President Obama’s health care plan, and that the government will pull the plug on grandma, and conduct death panels–well, your insurance companies already are, rationing health care, causing death for many, and have been making those decisions over who lives or dies for the most profit to corporations themselves.!

Unemployed and homeless mothers, grandmothers, fathers, sons–I have seen them all on our streets–those who have almost no hope, those ready to give up; they have not had health care for years!

They are the forgotten ones for whom Senator Kennedy fought for–that none might be lost to the rising sea of rabid conservatism, and the plundering of our nation’s job manufacturing by the pied pipers calling the greedy in search of cheap labor, where ever in the world they can find it.

Now! Right now, we must stand and decree that the Republicans and Blue Dog Democrats will rue the day that this Kennedy died, and if they would not pass health care, because he was not there to speak out against the greed.

Who–and how many in our congress and senate will now stand up and be lions for the natural citizens of the United States of America from these out of control transnational conspirators?

What happened here this afternoon, in a Eugene park we have all frequented at one time or many over the years, was a tragic interplay between two young,street people; one, a known homeless person stabbed in the heart, the other on the run and at large, but I suspect soon to be captured.

Other than the victim being homeless, and that this park is largely used by homeless people during the day as a quiet place to relax with friends, this crime may not have all that much to do with homelessness, but rather, that simply being out in public especially any where near downtown, Eugene is risking your life by being stabbed!

The Washington-Jefferson Park is one of several multi-user areas made unique because much of it is under the massive, bridge overpass where those two streets merge.

Bicycle paths circle around the park and there is a bike pedestrian walk-way over the railroad tracks, so that you can safely cross over the daily trains.

Under the huge concrete freeway ramp there is shade from the hot sun, shelter from the rain, a basketball court, and a local Christian group runs a Saturday “soup kitchen” to feed the homeless and anyone who is hungry, is welcome; and quite often they set up a table or two with used clothing for anyone to have. They have a band and lots of prayer, if that kind of music is your thing.

Truthfully, personally, this park is one I would never enter except with friends, near a large gathering such as for food; and unless I was riding a bicycle–never walking, using tables, or remaining in one spot alone–ever!

The worst thing about this latest crime of persons in public assaulting other persons in public, is that there is to be scheduled, in that very park a newly constructed skate park for young skateboarders, and such–a real cool addition for more use and enjoyment of the park.

This park is very close within blocks of where homeless campers are sleeping in vehicles that I refereed to in a previous article listing reported illegal camping from police reports for a typical week.

Without knowing any details of the murder, such as relationship between the two of them, motive, if was a drug related incident, or an outright attack on an innocent person who happened to be homeless, it remains a mystery as to why there seems to have been a high number of stabbings in and around Eugene.

Its like the knife rather than the gun, seems to be the weapon of choice among today’s street thugs; and knives are so easy to get, carry, and use to injure or even fatally wound the unsuspecting victim, who really might not see it coming in time to defend themselves.

Being safe at home from intruders, muggers, thieves, or stab-happy twenty-somethings, with secure doors and windows locked, and having a supply of rations is perhaps, much safer than hanging around the parks, though it is summer, that is the last park I would ever sleep in.

This murder took place at around 5:PM in the afternoon, which proves nothing about the nighttime safety of the homeless as being any more or less safe than daylight–in fact in broad daylight, visibility alone makes one more vulnerable to physical attack.

Yet things happen in all of the parks of Eugene, there are no exceptions, no safe guaranteed outdoor areas. Those homeless who live in vans, motor homes, camp trailers, etc with secure doors and locks are much safer than those without.

And, it affects my writing or lack of. Too many dead and dying people out there. Too much bad news. Too much caring, believing, hoping. It all dies whenever someone else dies for lack of it.

I die daily. I just shut down. TMI (too much information). I sleep to find comfort in death’s living sister, that murky slumber, where nothing but weird dreams exist, but are of no concern. A nap a day keeps the blues away–some times I must sleep all day–it does help.

Go, Mr. Obama! You are My President, I support you to hang tough and do not cave to “blue dog” democrats on the health care reform issue.

I reject the notion that these useless, disloyal Democrats are anything but “wolves in sheep’s clothing”! They are nothing but closet Republicans, who are too cowardly to stand up to their constituents, like real Democrats! They make me just as sick as their buddies on the Republican side who are determined to cause MY President to fail! Damn them for that!

No homeless individual, or family should ever have to lose vehicles, worldly possessions, camping gear, food, or clothing to impound while waiting for the City, or St. Vincent De Paul–but they are!

The homeless of Lane County are all misjudged and condemned; and all suffer for that which is clearly beyond their control. “Choice of Evils” defense is a must! Please help them to hang on and survive along their Homeless Trail of Tears! Thanks.

I am a formerly homeless resident, grateful for all those pro-bono lawyers and older homeless activists, who stood up for me in my hour of need, in defending my rights and taking back my innocence.

The USDA definition of food security is:

Food insecurity: “Limited or uncertain availability of nutritionally adequate and safe foods or limited or uncertain ability to acquire acceptable foods in socially acceptable ways.”

Hunger: “The uneasy or painful sensation caused by a lack of access to food. Hunger may produce malnutrition over time…Hunger…is a potential, although not necessary, consequence of food insecurity.”

Another thing–as a life-long registered voter, I will never forget that it was every one of you Republican S.O.B.’S who tried to starve myself, and all the poor here in Oregon, when they drastically cut food stamps several years ago, as a part of welfare reform war.

It is true, that citizens of Eugene, are those who eagerly arrest anyone who abuses or neglects horses, dogs, cats, etc., but refuses to do the same to those responsible for the abuse and neglect of its real human citizens, shelter needs.

The only question then becomes, can all of the hungry homeless people get to this food and make use of it, at least two or three times each and every day?

Bon-apatite, and Happy Thanksgiving! I myself usually attend this dinner and will do so again, this Thursday!

Homeless humans, will act according to Maslow’s Hierarchy of Needs, and no selfish, self-serving, man-made law but the natural creators law of the human individual’s will to survive, shall ever prevail, fulfilling the need for water, food, shelter, and sleep!

that requires storing said items for a minimum of 30 days, if they bother keeping them at all, for the owner to retrieve.

Look into the eyes of the many homeless people here, who live from campsite to campsite, food box to food box, from dinner line, to dinner line, what do you tell them? Be sure to have your emergency supply ready in your closets, too?

And of the importance of daily intake of food, otherwise the following symptoms begin to set upon one who lacks food:

“Irritability, low moral, lethargy, physical weakness, confusion, disorientation, poor judgment, weakened immune system, inability to maintain body temperature which can lead to hypothermia, heat exhaustion or even heat stroke.”

But what about the future of our food security?

We will, we will–tase you!

First of all, I would like to shock you awake from a few of your illusions, if that were possible. There are good laws, and there are bad laws; just like there are good cops and bad cops, good lawyers and bad lawyers, good politicians and bad politicians, etc.

Another illusion I wish to destroy, so that it not bind you to eternal ignorance, is that we damn well do torture! We worship the torturer like a God, and the right to torture–sacred.

Look for more and more of these hideous misuses of technology to be used against the populace, as unrest grows over the failure of the economy, and wars again, soon.

Oops! Sorry, we didn’t mean to shoot you–we meant to tase you!

Admittedly, there are a few lucky people here in Eugene who are alive today because our police now use tasers; and there are other people who would be alive today, had the police had the option of tasing them, instead of shooting them dead.

But what really pissed me off is when I heard that no officers are required in training themselves to be tased for the purpose of knowing what it feels like. That is so cowardly, and these guys are to be given free choice in their use of tasers against the rest of us? No, we don’t torture!
